1. Agreement to Terms

By accessing or using POPPIN (the "Platform"), operated by POPPIN LLC LLC, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use the Platform.

2. Eligibility

You must be at least 21 years of age to use the Platform. By creating an account, you represent and warrant that:

• You are at least 21 years old
• You have the legal capacity to enter into this agreement
• You will comply with all applicable local, state, and federal laws
• Your use of the Platform does not violate any law or regulation

3. Account Registration

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your credentials
• You are liable for all activity under your account
• You must notify us immediately of any unauthorized access
• We reserve the right to suspend or terminate accounts at our discretion

4. Subscription Plans & Payments

4.1 Free Tier ("Peek")

Basic access to bar listings, limited comments, and public profiles at no cost.

4.2 Paid Tiers ("Member" & "VIP")

• Paid subscriptions are billed monthly or annually at the rates displayed on the pricing page
• Subscriptions automatically renew unless cancelled before the renewal date
• Cancellations take effect at the end of the current billing period
• Refunds are issued only as required by applicable law or at our sole discretion

4.3 Business Plans (Bar Partners)

• Bar owner subscriptions provide analytics, listing management, and promotional tools
• Pricing, features, and terms are detailed in separate partnership agreements
• We do not guarantee specific business outcomes from promoted listings

5. User Conduct

You agree NOT to:

• Post false, misleading, defamatory, or harassing content
• Impersonate any person or entity
• Share or solicit illegal substances or activities
• Engage in spam, bots, or automated data collection
• Reverse-engineer, decompile, or scrape the Platform
• Circumvent security measures or access restrictions
• Use the Platform for commercial purposes not authorized by us
• Promote violence, discrimination, or hate speech
• Post content depicting minors or non-consensual activities
• Interfere with the Platform's operations or other users' experiences

Violations may result in immediate account termination without refund.

6. Content Ownership & Licensing

6.1 Platform Content

All design, code, graphics, logos, and curated content on the Platform are owned by POPPIN LLC Consulting LLC and protected by intellectual property laws. Unauthorized reproduction, distribution, or use is strictly prohibited.

6.2 User Content

By posting content on the Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content in connection with the Platform. You retain ownership of your original content.

6.3 Venue Content

Bar information, images, and descriptions are provided "as-is." We strive for accuracy but do not guarantee the completeness or timeliness of venue data.

7. Promotions & Events

• POPPIN may feature promoted bar listings, events, and special offers
• We are not responsible for the quality, safety, or availability of events or promotions
• All drink specials and event details are subject to venue discretion
• You attend events at your own risk and assume personal responsibility

8. Disclaimers

• The Platform is provided "as-is" and "as available" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure operation
• Live camera feeds are simulated for demonstration purposes
• Bar ratings and crowd levels reflect user sentiment and are not independently verified
• We are not liable for decisions made based on Platform information
• POPPIN encourages responsible alcohol consumption. Never drink and drive.

9. Limitation of Liability

To the maximum extent permitted by law, POPPIN LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to lost profits, data loss, personal injury, or property damage.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless POPPIN LLC from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Richmond County, New York.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use constitutes acceptance.
